My brother paid a deposit to a dealer on Tuesday for a caravan. He has since had second thoughts as there were things not included although advertised. Can he get the deposit back?
He's just rung trading standards and they say as he handed the deposit over aware that it was not as advertised he wouldn't have comeback. He would have to depend on the dealer being decent...what are the chances of that if the caravan was misreprisented
He made a mistake VW. Salesmen can be very clever and buyers can be dim/easily confused. I dare say I've done something simmilar myself in the past. I want to help him not blame him.
If he was given any written contract, check thoroughly through the small print and look for a get out clause. There may even be a cooling off period ?
We once backed out of a purchase of a brand new motorhome because they could not deliver anywhere near on promised time. I used the dealer's own contract to get my money back.

He has just looked and was only given an invoice with extras written on. They did talk about the 'missing' bits so I suppose that was an awarenss but in the confusion...
He says he feels such an idiot.
His mate says to put it down to one of life's experiences.
I'm wondering if he should forgo the deposit (£900) and look elswhere so the dealer doesn't get any more of his cash.
If the items were advertised surley they have to include them unless he has knocked the price down to not include them. Has he still got the advert anwhere?
Also on a purchase don`t you have a cooling off period, just a thought.
If he has an invoice with extras on does it state what the extras are if it does he may have a good case with the trading standards . If it just has extras but no description of what the extras are then you should have been made aware of what they were if he has paid by checque or card the bank maybe able to stop it worth a try good luck its an awful lot of money to loose
also what is he missing yhe missing bits might be worth less than the £900 he could loose but just get the van checked over to make sure it is ok .If the dealer has omitted certain things he may have also done that on the van you do normally get some sort of guarantee though in which case if you do go ahead get it inspected
The invoice will state what is included in the deal & he will have signed it. If it was a special offer advertising caravan+extras for a fixed price then that should be indicated on the invoice. If he is claiming that the salesmen verbally mislead him to believe that extra items were also included but he has no other proof of that, then whether or not his deposit is refunded is down to the goodwill of the dealer.
has he been back in touch with the dealers and asked what the extras are on the invoice and do they match as advertised. or his he having second thoughts and this is his excuse to pull out of a sale. let this be a lesson never sign on the day unless you are sure you need it and can afford it.
He needs a caravan but, if you read the thread properly was worried about the way the dealer had renaged on a certain few of the extras.
I'm not sure what you mean about need it and afford it. He has been saving up for his 'special' buy for the last 3years and has the money. He hasn't a bad bone in his body and wouldn't back away from an honest deal as he knows the difference between wrong and right. We were brought up to respect the feelings of others.
Personally I would turn up at the dealer and ask for my money back and giving the reasons why you wish to back out of the deal. Put it in writing. Then if this does not work make a protest outside of the premises using placards etc. That will get their attention.Do not respond to to any of their threats and keep your COOL,The dealer may inform the police,again keep your cool and inform them that you are holding a peaceful protest.Be prepared to talk to members of the Public.
If this does not work go to county court and get a claim form.Small claims court.The staff are very helpful. I did all this and got my £1000 plus the £50 from the dealer. Be POLITE and FIRM also speak Citzen Advice.
You could go to the dealers on their busiest day when they are making sales and put your case across loudly .No doubt they will try and keep you quiet in case other buyers back off would serve them right .I did something similar when I was sold a van and found damp I contacted the previous owner who said they changed it after it had gone back to the main dealer for the damp work to be done.Granted they offered to change it when I confronted them over it but as I had it for 6 months wanted £1000 depreciation value needless to say they didn't get it .But I got a different van Just know exactly what you were told and go back and complain to the manager in no uncertain terms like I did after all what more could you lose good luck keep us posted
