hi well here goes i took my ci motorhome in for its yearly mot. which due to them not being able to get parts ie mk 2 servo unit.square headlight which i found on ebay meant it was in there for 3 mnths so we missed the summer.
but hey at least it is now done but when i went there to pick it up i noticed that it had been broken into and the inside was trashed and all of our possesions gone they even went and got paint to throw about inside which went all over the place.
and of course the back door was damaged as well when i pointed this out to the owner of the garage all he said was well i never noticed that and when i asked him i hope he is insured he said no to which my wife went crazy and told him a few things which i cannot put on here.
what i need to ask you lot do you think he should by law have insurence?or is he ok to operate like this?because now me and my wife who is disabled have to start all over again now and do our van up again mad is it not eh?.
i know our beloved ford which is on an A plate 1984 is old but it is our pride and joy and we could not afford to replace it as we stand right now so we have to make the best of a bad job. and the wife will have to try her best and sort the seat cusions out which had paint tipped all over them.
anyone know where we can get material from without the paint effect[ha]you gotta laugh or it will drive me crazy. ah well thats got it off my chest now i feel better for that.i will keep you posted on any updates in the future .take care thanks for reading my bad luck story chat soon andy....

yeh thats what i will do asap and i forgot to say the thing that cut me up the most was they even nicked the cuttlery draw and contents [dont laugh] which as you know we had it full of things we need every day when out in our van and you cannot put that over to a garage guy can you?how can you value that eh?thanks for your reply anyway cheers andy..

The vehicle was damaged at the garage The garage has a general duty of care to look after your vehicle while it is in their possession, therefore if the vehicle is damaged at the garage, the cost of any repairs will be the garage's liability.

Hi welshguy, I'm verry sorry to here the trouble you've had,it doesn't matter how old your motor home is, its your pride and joy,and means everything to you.I only brought our motor home in june and within a week some SCUM bag tried to break in but was foiled.they did minor damage to the locks and paintwork. I was devastated.What goes through peoples minds to trash someones pride and joy.

He does not have to have any insurance except 3rd party motor insurance if he drives the vehicle. You do have the right to sue him to recover your losses, but I suspect you would only be awarded market value of the van by the courts, plus legal costs if you are lucky. Further more, since the van had no MoT when you left it with him, then market value could be considered to be market value of a van with no MoT, plus the cost of his bill.
Please don't say you have paid the bill, as in doing so you have accepted the vehicle in this condition and would seriously harm your case. He does have a right to hold onto the vehicle while it is on his premises until the bill is paid, but if it leaves the premesis he has no rights to reclaim it without going to court. You if you have to pay his bill, get him to sign a letter saying that you despute his charges and you are holding him responsible for the damage.
I strongly recommend you speak to a solicitor urgently. Most will not charge you for a first consultation.
I know nothing about the law inthis kind of circumstance but Sounds digital sounds like he knows what he is talking about so follow his advice and I would add not to go round and make a scene or say anything that could jeopardise your claim until you have had advice.
You may also get some free legal advice from your house contents insurance - worth a try along with a solicitor and trading standards and CAB may be able to help.
My Motorhome was broken into while it was at a dealer being serviced. They did nearly £3000 worth of damage.The dealer is doing the repairs and paying for it.

I was going to say this, weather the garage has insurance or not, it is their responsibility whilst in their care, not the same as a public car park, you handed over the vehicle for an MOT/ repairs, expecting it back in the same, or better condition than it was left in.
There only 2 things that really get my goat., 1: people who break into/wreck other peoples cars/MHs/Caravans/Houses, and 2: people who mess with families
