The op stated that the neighbour is a council tenant im now sure what this has to do with the complaint. It implies that because they are a council tenant then they are trouble. Some people are on the council or private rent due to reasons beyond their control, also some people are ex council tenants who were fortunate enough to buy the house they rented at a huge discount thus pushing house prices up leaving even more people unable to buy. I am not a council tenant but I would like to remind those who may need reminding that just because someone lives in a council house they are no less of a person than those who own a property. we are all equal and we have have to wipe our own backsides.

I agree, this is exactly how I read the opening comments. I would again report to the council housing department (landlord) It should also be reported to the environment department of the council as a statutory nuisance, especially as it has already been reported to the landlord.

Yes the council is the landlord of the property in which the neighbour lives.

It would not be the council as landlord that would have to deal with the problem, it would be their environmental department, as nanashirley says.
From a nuisance point of view it is irrelevant who owns the property. If the situation were reversed, and a council tenant were complaining about a home owner, the same rules would apply as they would have exactly the same rights and responsibilities.
this is because of the type of tenancy the occupier has. if it is a housing association, then they are responsible as they require the tenant to complete a tenancy agreement specifically forbidding this type of behavior.
you can access their agreements online at their website. study them then inform them that they are legally responsible for the behavior of their tenant. they will argue, but it is there in black and white.
if the housing is still council stock, then visit them and ask for a copy of their tenancy agreement and explain why. theirs should be the same.
if it`s private, then you are at the mercy of environmental health as a noise nuisance.
start a diary. log everything. times dates duration. everything. you are allowed to video withing your own boundaries, so use that to your advantage.
seek help from your PCSO`s. this is exactly what they are there for, evidence gathering.
ask for a meeting with the landlord and air your side, present the evidence and request a resolution. it is their legal obligation to resolve this.
involve your Councillor, and if they dont want to get involved, research THIS little gem. read the requirements, normally three unheeded complaints to the landlord and Councillor then drop that bomb.
I 100% guarantee they will sit up and take notice just at the mention of it..

i have just forced a housing association to move my family (we were private rented tenants) into a new property (with a different association) because of a catalogue of failings that they made. they tried to tell us it wasnt their problem, so i hit them with a community trigger, 25 pages of police intelligence, reports from veterans charities and loads of others. i totally buried them with paperwork and meetings until they agreed to rehouse us.
this isnt going to be easy if they want to dismiss you, but you have their own rules on your side.
Update we have reported her again and the The Landlord ( the Council ) have been to see us regarding the noise, they took a copy of an audio recording i did on my phone of her swearing at us one night when we went round and politely asked her to turn the music down, he said he would be going to see the neighbour and she will most likely be getting a first written warning, thank you to all who replied hopefully she will calm down now.
