I take it you didnt read all my post then ? I agree they are entitled to privacy when not carrying out public duties.
If kate made a statement saying big deal its only my tits, no one would be interested and magazines wouldnt sell more copies for printing the pics.The fact its a hard picture to get just makes the bounty go up and the people trying to get the bounty try harder and make their life less private.
what I think quite interesting about this post is that it was only posted at 10.19am on 14th sept and already clocked up 2362 views at 16.40pm today but only 68 replies so who were all the perverts out there hoping to see the actual pics here lol

The French lawyers are saying it's as illegal to take photographs of individuals in a private setting as it is in this country. It doesn't matter whether the lady is a future queen or a lavatory attendant, nor whether she is in the bathroom or in a private garden, nor whether there is a road running by or a canal full of narrowboats... it's the equivalent of taking a telephoto shot of a woman undressing in her bedroom. She was not in a public place and therefore her privacy was illegally invaded. The Law is important. All other considerations are secondary.
I was under the impression its not illegal to take photo's from a public place as long as their not used for anything other than your own collection but it is illegal if you sell or publish them without the proper consent forms being signed by the subjects and I thought this also included certain types of buildings maybe Phil can clarify that one
Perhaps that's the illegal bit, then. I read that the French lawyers had confirmed that the actions of the photographer and the magazine were illegal. They didn't specify which actions, so if you're right, they meant the selling, not the snapping.
So it's legal, then, to take pictures of someone (albeit carelessly!) undressing for bed, from the secrecy of a dark lane or a handy hedge 'for your own collection'?! Well I never! How sinister!
My main point, though, was that the Law is for everybody, and we shouldn't be making judgements on whether she deserves to be protected or whether she should have expected it once she was queen-to-be. She has the same rights as anyone else.
If it turns out she is not protected by the Law, for my own sake I'd like to know why not.
In France, the penalties for publishing are far outweighed by the profits made from selling such tosh. Therefore they take the fine and pocket the profits from increased circulation.

Hope not but it does seem the legal sides are a bit vague.
Had a bit of a problem at our village fete as a photographer was taking pictures of all the children in a fancy dress comp he then tried to sell them to parents and the local rag
people got angry and got a solicitor involved he was told it was illegal to sell or publish without a model release form but not illegal for him to have photographed them.
All that info came second hand so don't know if thats all fact or faction

I know we always have to have permission from parents before we photograph the Brownies at events such as the Carnival, but I don't know if that's the Guiding regulations for the safety of all or a legal requirement. When I organised a ship-related convention in Portsmouth we had a guy making a video of our event, and he distributed consent forms to everyone present to cover himself, but again I don't know if this was just for his own peace of mind or a legal thing.
The Brownie photos would never be offered for sale, but it was our intention to sell the video back to the attendees of the convention. In the end we were able to give it as a freebie, so the problem would not have arisen.
It's an interesting question. I hope someone knows the answer.
Kate and Will, were on private property. Could not be seen by the general public, never mind take photos. Therefore not in the same league, as someone sunbathing topless on the beach.
Only someone with a powerful telescopic photo lens would be able to take photos.
Maybe a member of the public, who enjoy star gazing and own a powerful telescope could have spotted them.
The photographer is in hiding at the moment. I don't know why, as noone has revealed the identity, as the papers are not obliged to reaveal the identity.
If the papers think if they could get way with publishing these photos. Next time photos published could be more explicit. High payment is the driving force.

To be honest the ones on the web..type in KM topless, shows blurry pictures and could be anyone.Unless the ones in PC are any better the magazine itself is not a bad read.

It's not 'just smut' really, is it? The girl was photographed from a kilometer away by a guy hiding in woodland, and her half-nekkid pictures splashed around the world. If the sinister nature of that isn't an issue for debate, I don't know what is. If privacy isn't protected now, we'll have none whatever in a few years' time!
