Hi, a retailer did something that I think is a bit naughty, and I wonder if I am out of line or not, and if not, do I have any come-back?

Last year I bought a Wolf Lake 5 via internet (Mar 10) from one of the major retailers.  I pitched the tent in the garden, however I didn't hose it down and it didn't rain during my test-pitch.  We then went on holiday to France (Jun 10) and the tent leaked, however because I was outside the 28-days-since-purchase when I discovered the leak, the retailer would not agree to a refund but said if I sent the tent back they would investigate and replace as necessary.  So I sent the tent and ZIG to them.  The retailer advised me the polycotton was the problem and they replaced it.

I got the tent back, I pitched it at home (it rained and didn't leak).  I put the tent away for the winter months and didn't take it out again till yesterday and pitched it in the garden.  I notice that the tent is actually now a two-tone tent and I deduced that the retailer replaced the polycotton of the tent, but before returning the "new" tent to me they attached the "old" originaly porch area of the WL5 (which had faded quite a bit, surprisingly, in 3 weeks of French sunshine).  So the result is that the porch is now a paler shade of green than the rest of the tent. 

I think this was naughty of the retailer and wondered if I am out of line in thinking so?  If I am not out of line, is there anything I can do about it at this stage (it was about Sep 10 by the time the retailer sent me the "new" tent, so we are talking about 8 mths ago).

Its not a big problem, but I hate to feel like somebody was naughty to me like this, it bugs me!

The problem appears to be with the tent and not the porch so they simply replaced the tent and returned it along with the porch to you.

Did they ask you to return the porch as well or did you just include it as part of the package??

yes maybe it was a bit naughty of them but they did replace the faulty part which is all they are obliged to do

Are you talking about a separate add on extension or a porch that is an integral part of the tent?

I think they fullfilled their obligation in replacing the leaking tent but it would have been a nice gesture replace both as I assume that the porch is actually part of the tent on the wolflake

If they have sold a faulty product, they are in breach of contract. So you do have a right to a refund if you are unhappy with the remedy offered.

Hi, thanks for the replies.  Just to answer the question ... the porch of the Wolf Lake is part of the entire-tent and sold by all retailers as ONE item (it is not an optional extra).  So I suppose my view is that if they are needed to replace the tent polycotton, that it should have been for the whole tent (which included the porch) - it never entered my head that I'd be left with a two-coloured tent because they would only replace part of the polycotton tent but not the entire thing!  Anyway, I suppose that in time the "new" tent will fade so that the colours will be the same .... thanks everybody for your replies.

The retailer did fulfil their obligation, if you buy something that develops a fault it has to be repaired or replaced by the retailer. They are under no obligation to replace it or refund your money, so they have essentially repaired it by replacing the part that was deemed faulty.

If it was me, I'd be kicking up - if the porch is not an optional extra and is part of the tent, they should have replaced it.

If a panel on my car was resprayed because after I'd bought it I noticed a mark, I'd want the colour to match the rest!
