I paid deposit by cheque.  Terms and conditions say 100% due for cancellations between 1 & 7 days.  Which is fine, but I wouldn't have cancelled if it had been satisfactory.  The cancellation ended up costing our group more money to amend the travel plans back home!  He reckons he has his own evidence from cleaner/other bookers etc.  If it looked filthy I could have taken a few photo's or something, but you can't exactly get evidence of a smell.  I'm happy for him to keep the £55 deposit which I have paid - as that's already gone, In my opinion that should pay for any provisions which he had bought for our stay and I shouldn't have to pay him any more.

If it went to court and he won - how would they get the money off me?  Would I end up with a criminal record in France if I didn't pay it??

The cancellation thing is to protect them against loss of earnings because the accomodation is booked and can't be let to anyone else.
In all honesty I don't think you have a leg to stand on. When you paid the deposit you accepted the terms and conditions.
