Has any one had the same issue as me.

Bought Ace Jubilee feb 2007. within 12months an area of spotting, mildew type effect appeared between the outer and inner sections of the front center window. It was the same mirror image replicated on each section. The window was replace, then within 12months or so the same fault occurred, the window was replaced, then again within 12 months or so the saem fault occured, however Discoer are now saying that the van is out of warranty period and Miriad will not replace the window.

I beleive that this is an inherent fault as Swift indictae that Miriad have re engineered a new window which should rectify the fault. I am about to start a smalls claims case against Discover, Darlington under the Sales of Goods regs, and wish to know if anyone has had a similar problems and if they have any correspondence or emails from their dealer, Swift or Miriad confirming this fault, or if their dealers have rectified the fault so that I can prove the inherent fault exsisted when I bought the van, as a result of the faulty design from the outset, and with the subsequent replacement windows.

Cheers Thanks for your help. Plodder1

Hi I have a 2009 Challenger with the same problem, waiting for Robinsons at Worksop to replace. Judging by my conservation with them its a common problem.

Ron57, thanks for that. Can you do me a favour and before you have the window replaced, make a note of the markings, serial numbers on the window that is faulty, then when they replace it make a note of the new details, then let me have those details. There is a little sticker on each window and they have a few digits on. One is a 4 numbered digit something like 0604, which I beleive is a date of manufacture.

Also if they do replace under warranty can you make a note of the date they change the window. This will help me alot with my situation as it will help establish evidence of an inherent fault which I need to prove to be successful against Discover of Darlington.

Thanks  Plodder1

I will look up that forum, as we have a bit of "crazing" on our front windows, plus a bit that looks like Harry Potter's forehead, but OH thinks this is due to sun damage, worth a look though.

Thanks Jennifer,

I have been in contact with Swift and it is claer that they are aware of the problem but have passed me back to my dealer who has said Miriad will not replace as the warranty period has ran out and they appear reluctant to sort the matter as the seller. I am still trying to see of swift can help and am awaiting a loggin registration for the swift talk site as  have read some posts there.

I am just preparing the ground as information from various sources will substantiate any civil claim based on the  'in all probability rules'.

Hopefully Discover will do the honourable thing, but after a conversation I had with them to day I wont hold my breath. Im not one for being fobbed off or p*ssed off and somethings are starting to point in that direction. Any court action however will assist more than simply me as I will be able to provide tested proof that the inherent fault exsists. I will also be asking trading standards to take a stand in relation to the matter not for me as an individual but for the hundreds of people who will have suffered loss as a result. This matter should need to be addressed once. If they parties involved know of  a design fault and try to cover up or take steps to prevent consumers accessing their legal rights by withholding known information they actually commit a criminal offence not just a civil consumer act offence. Miriad Swift and Discover clearly know of this fault but are unwilling to provide the essential information to consumers that would enable them to access their legal rights.

Any documentation correspondence that people have relating to this matter will form the basis of a civil claim and invetsigation by trading standards.

See what I mean when I say my cage has been rattled, unfortunaletly the key was left in the door and its just swung open

Well, both Swift and Miriad have been very helpful as far as I know, certainly to us and several of our friends, so I do not understand why they have not helped you.

Our first centre front window developed the marks (April 2008), it was replaced at our service in 2009, but that one went too. We had the present one fitted in February 2010 and it has been fine....towed over 5000 miles.

It is massively thick compared to the first 2, you can certainly see the difference.

Our van was built Feb 2008, if that is significant.

Sorry but I think your problem lies with Discover if my experience has anything to go by. See if Swift will bypass them.

Yep, I would agree. This problem has had a lot of publicity on various forums, and it is not only Swift vans affected.

IMHO, both Swift and Miriad have acted very well.

It is a known problem.  Many retailers are replacing windows because of the rubbing together of the two 'skins'.  We are still waiting for our replacement.  Stories of the retailer forgetting to order it, then the original person who dealt with it left, then after re-ordering the window manufacturer said they didn't receive the order.  It's been a bit of a nightmare, and my patience is rapidly running out.  I am due to ring hem next week, and if I get no joy, I will go straight to Bailey.  I have kept a very clear record of dates, telephone conversations, promises etc. which I will be putting in writing to them and will be considering my next options if I don't get anything positive next week.

a friend had the same problem with his centre front window.it looked like a football had hit it in the centre and left a slight mark.he said this was a second window with this fault and his dealer did not tell him why it was happening.i explained it was the front and rear rubbing together.i said contact swift direct as he also had a cracked shower fault.this he did on that day and was told all the problems would be corrected the following week.he had to lose a day on site.there are 1000's of windows delaminating and rubbing not just swift, its a major problem.

I posted a query on Swift Talk this morning, and I have had a reply from swift asking me to pass my van details etc to them. I will keep you posted on the outcome.

Keep the posts and info coming though as until this is sorted I am still in the evidence gathering mode, (due to my profession) and dont take lightly to being nobbed off by some pen pushing, jobs worth of a customer service ilk !

Cheers Plodder1
