Walking my dog on wednesday I noticed there were a number of cars parked partly on the footpath. I believe this is illegal but that is a matter for the police me thinks. But it does slightly annoy me as I sometimes have to walk into the road. However on this day there was a young guy coming the other way in a wheelchair. I gave way on the path and as he passed I heard a scraping noise and noticed he had put a deep curved scratch on the car door from the chair or his watch. I have to admit I had a chuckle to myself and thought DISABLED 1 - CAR OWNER 0. If everyone parked the correct way on the road there would be no need to have speed camera van parked there regularly as everyone would slow down due to natural obstructions.

It's actually the local councils job to enforce parking restrictions. Usually they are quite strict. Maybe a phone call to them will help the situation.
This annoys me to when there is no need for it. Sometimes it can be justified, often people do it out of (bad) habit.
I guess they expect the disabled, mothers with prams etc to walk in the road.
The guy in the wheelchair probably did it out of mischief and I don't blame him.
It depends on the area of your country who deals with parking issues. If the offences have been decriminalised then the local authority will be responsible for enforcement of offences such as double yellow lines / no waiting areas etc. However if there are no parking restrictions in force on this road then the offence is one of "causing an obstruction of the highway" (and a highway includes the pavement) and this is enforced by the local police.

even so do'es that give disabled people in wheel chairs or any one else the right to cause damage ,accidentaly or otherwise, to some-one's car and simply carry on on their way as if nothing had happened ?
imoho that makes them no better than the numpty who parked half on the path
not only that but to damage someones car this way, is tanter-mount to causing criminal damage and should have been dealt with accordingly dis-abled or not.

no it doesn't give them the right but at the same time please don't assume that it has been done on purpose. My mum and husband are both in wheelchairs and we often had to squeeze past cars that have parked thoughtlessly halfway across the pavement. Sometimes it is really tight and I have acidentally scratched a car once or twice. Did I do it on purpose? No, did I feel guilty? No if that person hadn't parked so carelessley then the damage would never have happened. I won't damage a car on purpose but if it happens accidentally thanks to their selfishness then I don't see why I should feel guilty.
The other ones that annoy me are people who block the ramped section of the pavement that allows wheelchairs access to the road or people who park in disabled bays when they either don't have a badge or even worse use a relatives badge if that relative is not in the car. They ones who don't have badges may not realise how difficult it is for someone to struggle across the carpark in bad weather with a wheelchair because the disabled bays have been used by someone who doesn't need them, but the ones who abuse relatives badges are the worst because they should realise how much those bays are needed by disabled people

So the guy in the wheelchair scratched the car at the same time he was passing you?
If so then there was plenty of room for him to get past and he was little more than a vandal.
If it’s illegal to park on the pavement then why do councils encourage it where there is room?

When my kids were in pushchairs, I would squeeze past cars. As far as I am aware if your car gets damaged whilst parked on the pavement you have no legal rights at all if it gets damaged by pedestrians trying to pass.
Can I ask how and where councils encourage people to park on the pavement??

I agree with Miss B.there is no excuse for parking a car up on a pavement.As well as people in wheel chairs not being able to get by what about blind people who have to walk on the road.If you get your car scratched through some one in a wheel chair trying to get by well i have no sympathy for you,you shouldnt be on the pavement in the first place.
Hi, Not sure where I heard this, its some time ago now, that it is illegal to park or partially park on kerb foot path, and if law enforced it carries a fine of £1000 per wheel, maybe the knowledgeable guys in this field can shed some light on this, I have every sympathy for the person in the wheel chair, as I know how hard it is negotiate obstacles at the best of times. Must admit I have scored a car when trying to get my father-in-law out of his house by the side door (and only door), the guy up stairs continually parked his car across the front of the step only two feet from step, had asked the guy on numerous occasions to leave space for me to get wheel chair out, and there was a very good chance that his car could be damaged, he just ignored the requests. His car did eventually get damaged, dented and scraped, (accidentally I may add). He never parked there again.

Parking on on the footpath is not 'careless' it is deliberate. In many cases cars have to park on the footpath or they could not park on that stretch of road at all as traffic could not get thru on the road.
Parking half on the pavement is normal in residential streets when there is no other choice. To just say that half the residents of that street should park elsewhere is being unreaslistic.
Yes it is illegal to park on the pavement but what people fail to realise is that it is also illegal to park on the road. Legally any vehicle parked anywhere on the public highway is causing an obstruction & you park only at the discretion of the police.
If the police & parking authorities decide it is ok to park on the pavement in a certain road, then it is.
As for accidental damage caused by a wheelchair to a car then that is a civil matter. Certainly those that drive powered wheelchairs & mobility scooters on the pavement & roads should at least have 3rd party insurance. Although not yet a legal requirement it is certainly advisable.
Parking like that really annoys me i'm not diabled or anything , but the traffic still has to go on the wrong side of the road, so there is no point.
There is a disabled girl lives up the road i'm on and she and her helper go for walks daily saturday she went out down the road was 6 cars parked half on half off the road on the bend, now causing people to drive on the wrong side of road around a bend,
her helper went back in and 10 mins later came out with some paper and went and stuck one on each screen of car, sticky note, It said the Pavement is for perdestrians the road is for cars and they should not be parked on a bend in the first place Oh and just to say your registrations has been noted and will be sent to the police.
would just like to ask those of you that are villifying the parked cars, how many of you that drive can honestly say you have NEVER done the same thing ?
oh i know you'll all chime in and CLAIM never to have done it but in truth will have done at some point or is that just me being cynical ?
people in glass house's really shouldn't throw stone's ,or is it just a case of do as i say not as i do ?
