My wife and I put a deposit, quite a large deposit I might add, for a fleurette, on 01.03.14. Unfortunately I had to ring and cancel on 08.03.14, the salesman, in fact the same we had dealt with, assured me we would have the full deposit refunded.
I then spoke to the owner on the Monday, he said it would take 10days but I would be refunded, the full amount.
It has taken slightly longer, but Campers and Leisure have refunded me my £1500.00 and I would like to thank them for their sheer professionalism.
Having read some of the problems other people have had, I count myself very lucky, although the only reason I went to them in the 1st place was the recommendations(from posts they had either answered or written) of people who use this site, so I thank them too.
Oh well, fair do's then, but I don't think generally its good to leave a deposit. If you are not in a position to conclude the deal there & then its quite possible things can change. Theres more than one perfect caravan out there & once you have paid a deposit, usually non returnable, you are bound to find one more perfect, or other things can change.
Obviously if you are ordering a new caravan for delivery from factory at a later date then you may have to leave something but no more than you can afford to lose, say £200 which is sufficient to compensate dealer for extra paperwork etc if you do cancel but certainly no more because the dealers needs the business more than you do.
I thought no matter what the deal is or how much deposit you leave under the sale of goods act you have at least a 14 day cooling off period in which you can cancel and get your deposit back in full.
No, a deposit is part of a legally binding contract, it can be argued that a deposit was excessive though & part of it returned but trader is entitled to compo if deal is cancelled by customer. The only way it must be refunded is if trader fails to supply goods &/or correct goods, or misrepresents goods in some way. One could also argue that if a trader fails to supply goods in a reasonable time they should refund deposit but caravan traders generally have that one covered in their t&c's & won't guarantee a delivery date.
All this for retail sales from a premises. Mail order is different & does have a cooling off period, I think.
When we put the deposit down the sales man did say the deposit would be fully refundable if we changed our minds, but they could have acted differently I suppose.
