we purchased a 3 year old unicorn cadiz on 2/7 2016 from a so called reputable dealer.
while waiting for the salesman to complete the deal , he nipped off , i had a look at the file regarding the van , well it had my hubby's name on it
there was a check list inside , which we were never shown
all ok until i get to the part that said 25%/to 95% damp in the bathroom area.
we had asked about damp on viewing the van and was told
oh we never take anything in part exchange with more than 10% damp
,so i asked what this meant and he said
oh that has been fixed and anyway you have a 3 year
warranty .
well at that moment suppose we were caught up in the moment and very stupidly& naively paid the balance of £16,000 paid by debit card
however having been away for the week end we have now discovered a few other faults ,
one of the locker doors is faulty , the actual barrel on the lock fell out on the journey home , luckily didn't spill the contents ,
the window blind is broke wont open / close , come off its track .and all wrinkly , the water pump is extremely noisy,
the second hand motor mover which was supplied as part of a package with the van , the handset faulty and the roller is badly worn,since found out the mover is 12 years old ,
Hubby phoned them today and i think was basically fobbed off told to put it all down in email which he has done
so as you can imagine we are totally gutted and have completely lost faith in the van .
this was to be our forever van until we gave up carravanning, having come to it all quite late having only owned one van before
what are our legal rights . i know about sale of goods act , but unsure how this affects us with a secondhand caravan, can we reject the van and as dealer to take back ? , many thanks in advance
Sale of goods act is now the Consumer rights Act. From what you describe it would appear you have a right to full refund within 30 days of purchase. Read this. You need to take it back now & require a refund. If you agree to a repair & it goes past 30 days after purchase then automatic refund right no longer applies.
If you are in the Caravan Club they have a legal help line. I have had similar problems helped by Trading Standards who advised checking the names on their Trusted Trader list. The fact no caravan dealer was on it just about sums it all up!
Hi misterg . i have phoned the c&cc help line and they have advised us that because we are within 30 days we can legally reject the under the consumer rights act 2015.
which we are going to to do . thanks for your help i will keep you updated .
Sorry to hear about your bad luck. I bought a brand new Unicorn Valencia last year and there's a bit of a saga attached to that - perhaps exacerbated by the fact that I dare to store my caravan in France and have all my holidays there, so it's not been easy to get all my faults rectified. Salesmen rely on feeding you with bull**** in order to sell the caravan so that they can get their commission and integrity is not a priority.
I have taken advice and have been told that the odds are stacked against me if I take it to Court and try to get my money back - but good luck anyway.
Hi l have just bought a bailey pegasus from a dealer based in combe martin , the lights on front did not work so i contacted them as we were going to their campsite,when we got there i was told there would be a call out fee of fifty pounds to come to check the lights which the caravan was on the site ,so I can see how other people get fed up with dealers take your money and wash hands of it as soon it leaves the forecourt.
